Urgent Protection of the Tempisque River: Constitutional Court Orders Immediate Action

A judicial ruling in defense of one of Guanacaste’s most important rivers

The Sala Constitucional de la Corte Suprema de Justicia issued an order requiring several State institutions to design and implement an urgent plan to protect the Río Tempisque, considered one of the most important hydrological, ecological, and productive axes of Costa Rica’s northern Pacific region.

The resolution responds to growing concerns about the river’s environmental deterioration, affected by agricultural pressure, water extraction, pollution, and alterations to its natural flow — factors that directly impact surrounding ecosystems and the communities that depend on this resource.

Ecological and social importance of the Tempisque River

The Tempisque River crosses large areas of Guanacaste and feeds wetlands, mangroves, and protected areas of high biological value. Its basin supports activities such as agriculture, livestock farming, artisanal fishing, and tourism, in addition to being a vital source of water for numerous communities.

This river plays a key role in maintaining the balance of ecosystems such as the Palo Verde wetland and other biodiversity-rich zones inhabited by migratory birds, reptiles, fish, and species typical of estuarine and freshwater environments.

The deterioration of both water quality and quantity represents not only an environmental issue but also a risk to the region’s water and food security.

Institutions required to take action

The judicial order involves entities such as the Ministerio de Ambiente y Energía, the Instituto Costarricense de Acueductos y Alcantarillados, and the Servicio Nacional de Aguas Subterráneas Riego y Avenamiento, among others, which must coordinate concrete actions to halt the river’s degradation and ensure its gradual recovery.

The ruling requires technical planning, monitoring, regulation of water use, and environmental protection measures adapted to the current state of the basin.

Beyond water protection: biodiversity conservation

Protecting the Tempisque River goes beyond managing water as a productive resource. It involves safeguarding critical habitats for numerous species, preserving biological corridors, and maintaining the balance of wetlands and mangroves that directly depend on its flow.

These ecosystems perform essential functions such as local climate regulation, carbon capture, flood protection, and supporting entire food chains.

An important environmental precedent

The intervention of the Constitutional Court sets an important precedent in the defense of natural resources in Costa Rica. It reinforces the idea that environmental protection is a collective right and a State obligation, especially when strategic ecosystems are at stake.

This type of ruling also highlights the growing focus on integrated watershed management and the need to balance productive development with environmental conservation.
