Constitutional Court accepts citizen claim over environmental permit
The Sala Constitucional of the Supreme Court of Justice of Costa Rica (also known as Sala IV) is reviewing an amparo petition filed against the Secretaría Técnica Nacional Ambiental (SETENA) over the environmental approval granted to a community dock project in El Higo de Pavón, Pavones, Golfito.

The petitioners assert that the approval:
• Was issued without a direct field inspection and relied on studies that “underestimate local conditions.”
• Affects an area entirely within the Maritime Terrestrial Zone, considered state natural heritage.
• Lacks key analyses such as hydrological, oceanographic, and coastal dynamics studies that would be necessary to predict construction impacts.
• Conflicts with independent technical reports identifying the area as secondary forest and mangrove, highly sensitive ecosystems.
Ecological importance of Golfo Dulce
The amparo cites the ecological significance of the Golfo Dulce, a tropical fjord with low water renewal, home to species such as sharks, cetaceans, and coral communities. Petitioners argue that poorly evaluated intervention could create cumulative effects that are difficult to reverse.
They also raised concerns about potential impacts on tourism and surfing, as Pavones is known for one of the longest left-breaking waves in the world, which depends on specific seabed conditions and sediment transport.
Court action and next steps
The Sala IV has ordered SETENA to provide a detailed report within three business days addressing the allegations in the amparo. This report will clarify the environmental authority’s technical and legal position.
The legal process comes amid community concern after initial construction phases of the dock reportedly failed to withstand strong waves.
